This User Agreement – Personal Accounts (the “Agreement”) exists between the applicant (“you” and “you”) and Amazon Payments Europe s.c.a (“Amazon Payments”, “we”, “us”, “us”, “our”). The Agreement applies to your use of our Wallet services (the “Service”). Our service allows users with personal accounts (described in section 1.1 below) to make payments to users with reseller accounts (as described below) via internet or mobile services and applications. This Agreement applies to your use of the Service, whether you make payments or access the Service using an application operated by a third party or by us or by a company controlled by us or under common control with us (a “Related Company”), including our primary websites in pay.amazon.co.uk, pay.amazon.de, pay.amazon.fr, pay.amazon.it and pay.amazon.es (together, the “Websites” and a “Website”, if any). A “Merchant” is any third party that accepts payments through the Service and a “Reseller Account” is that Reseller`s Amazon payment account or any other account of the Reseller that accepts the Service. For the avoidance of doubt, Amazon Payments is the payment service provider of the reseller associated with the service, except where another payment service provider allows a merchant to accept the service. Your payment service provider is the entity that issued your card (defined below) or another payment method. Any dispute or claim regarding the Service, your visit to the Website, Seller Central or the MWS Site, or the products or services we sell or distribute through the Website, Seller Central or the MWS Website (including, but not limited to, the Service), will be settled by binding arbitration and not by a court. We reimburse these costs for claims totalling less than $US 10,000, unless the arbitrator finds that the claims are frivolous. Similarly, we will not charge attorneys` fees and expenses in arbitration proceedings unless the arbitrator finds that the claims are frivolous. You may choose to have the arbitration conducted by telephone, on the basis of written deposits or in person in the country where you live or in another mutually agreed place. You and we agree that all dispute resolution proceedings will only be conducted on an individual basis and not as part of a class, class or representative action. . .
